GENERAL TERMS AND CONDITIONS
§ 1 Identity
The following contractual terms and conditions shall apply to all services and deliveries offered by the website www.shirtsforflirts.bigcartel.com.  By placing an order, the purchaser accepts these terms and conditions, so that they become an integral part of the contract upon its conclusion. The contract is concluded with : Isabell Wiehmert is hereinafter also referred to as the "Seller". Disclaimer: Despite careful monitoring of the content, the seller accepts no liability for the content of external links. The operators of the linked pages are solely responsible for their content.

§ 2 Conclusion of contract
The Buyer is requested to note that the products offered by the Seller on this website can only represent a non-binding offer and are subject to corresponding stock levels. The Seller endeavours to have the offers in stock at all times, but cannot guarantee this in every case and in particular not in every conceivable quantity. In the event of typographical or printing errors or technically induced transmission errors in the item description or other declarations of intent, the Vendor shall be entitled to contest the order, provided that the Vendor can prove the error. The stated price is the final price plus shipping costs. The order is placed by pressing the button "Order" after entering the required data. The purchase contract is thereby bindingly concluded. The buyer will then immediately receive an order confirmation by e-mail. The buyer shall ensure that the e-mail address provided by him/her can be reached. Pursuant to § 130 of the German Civil Code (BGB), e-mails are deemed to have been received if they are stored in the recipient's mailbox and can be retrieved under normal circumstances. If the Buyer has not received a message from the Seller within 24 hours of placing an order, the Buyer is advised to send the Seller a brief notification. The essential characteristics of the goods offered here and the period of validity of any limited offers can be found in the respective item description. Within the framework of the Seller's obligation pursuant to Art. 246 c No. 3 EGBGB (Introductory Act to the German Civil Code), the Seller points out that the Buyer may correct his data at any time before submitting the offer. After entering the data, the Buyer receives an overview of the data he has entered and can check and correct it again. The text of the contract is stored by the Seller and can be made available to the Buyer at any time.

§ 3 Prices, shipping, payment
We deliver as good as everywhere. The buyer shall bear any customs duties and import sales tax. He shall indemnify us against any claims in this respect. The invoice amounts are due immediately. Payment is made through PayPal or Stripe. 
The transfer to the postal or parcel service usually takes place three to four working days after receipt of payment. The shipment is usually carried out by DHL. If insured shipping is desired, please indicate this when completing the order. The shipping costs will then increase in each individual case. If the shipping costs are 5 Euros (national) or more when the order is placed, the shipment is automatically insured. Please note: Delivery times of the post office within Germany 1 to 3 working days, international shipments between 3 to 7 working days. The buyer is responsible for any customs duties incurred outside the EU. The buyer must ensure that the delivery company delivers an undamaged consignment. If necessary, this must be opened in the presence of the delivery person. Please do not accept a torn or obviously opened consignment, as otherwise the receipt of the delivery in perfect condition is tacitly confirmed to the deliverer (in case of doubt, note the name of the deliverer).


§ 4 Right of revocation and consequences of revocation 

The buyer has the right to revoke the concluded contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which the buyer or a third party named by him, who is not the carrier, has or has taken possession of the goods. In order to exercise the right of withdrawal, the Buyer must inform the Seller by means of a clear declaration (e.g. e-mail) of his decision to withdraw from this contract. In order to comply with the revocation period, it is sufficient for the purchaser to send the notification of the exercise of the right of revocation before the expiry of the revocation period. Consequences of the revocation If the Buyer cancels the concluded contract, the Seller shall repay all payments received from the Buyer, excluding the delivery costs without undue delay and at the latest within fourteen days from the day on which the Seller received the notification of cancellation of the concluded contract. For this repayment, the Seller shall use the same means of payment that the Buyer used for the original transaction, unless expressly agreed otherwise with the Buyer; in no case shall the Buyer be charged any fees due to this repayment. The buyer shall bear the direct costs of returning the goods. The buyer shall only be liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the quality, characteristics and functioning of the goods. End of the cancellation policy. Exceptions to the right of withdrawal The right of withdrawal does not apply to distance contracts for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to the customer's personal needs. Whether the delivered goods fall under this exception can be taken from the respective product description. If the seller considers the goods to be exempt from the right of withdrawal, the product description shall contain a corresponding note.

§ 5 Retention of title
We retain title to the purchased goods until all claims arising from the delivery contract, including ancillary claims, have been paid in full.

§ 6 Statutory liability for defects The statutory rights of liability for defects apply. Most products are handmade. Thus, variations in colour, printing, etc. may occur. These points are not considered defects and do not trigger any warranty claims. The seller does not accept any warranty for damages caused by improper use, natural wear and tear. Upon arrival of the goods, the customer must immediately inspect the goods for defects and condition. In the event of obvious defects, these must be reported to us by e-mail within 14 days. Otherwise, the warranty for these defects shall lapse.

§ 7 Data protection The buyer's data shall be stored to the extent necessary for the fulfilment of the order, in compliance with the provisions of the Federal Data Protection Act (Bundesdatenschutzgesetz) and transmitted to the respective forwarding agent or other vicarious agents involved in the order for the purpose of fulfilling the contract.

§ 8 Applicable law
The law of the Federal Republic of Germany shall apply exclusively to all disputes arising from the contract.
